These Terms of Service ("Terms") govern your use of the GIFTiR platform ("Platform") operated in the Kingdom of Saudi Arabia. By using the Platform, you agree to be bound by these Terms in accordance with the Saudi E-Commerce Law and Consumer Protection Law.
1.1 You must be at least 18 years old to place orders. By using the Platform, you represent that you meet this requirement and are legally capable of entering into binding transactions.
2.1 You must provide accurate and complete information when creating an account. You are responsible for safeguarding your credentials and for all activity under your account.
2.2 Providing false identity or payment information is a violation of the Anti-Fraud Law (Royal Decree No. M/16).
3.1 Orders are subject to acceptance by the relevant designer. Prices are displayed in Saudi Riyals (SAR) and include applicable VAT where required by ZATCA regulations.
3.2 Payments are processed securely through Stripe. By placing an order you authorize the Platform to charge the displayed amount to your chosen payment method.
4.1 You are entitled to the rights granted under the Saudi Consumer Protection Law (Royal Decree No. M/54), including the right to refunds and returns as described in our Refund Policy.
4.2 Product descriptions must be accurate; any misrepresentation by a designer entitles you to a remedy under applicable law.
5.1 You agree not to misuse the Platform, including fraud, abusive behavior toward designers, fake reviews, or any activity violating Saudi law or Islamic principles.
6.1 GIFTiR acts as a marketplace connecting gifters with designers. The Platform is not liable for the quality or delivery of individual products, which are the responsibility of the respective designer, except as required by law.
7.1 Disputes shall first be addressed through good-faith negotiation. Unresolved disputes shall be submitted to the competent courts of the Kingdom of Saudi Arabia.
8.1 GIFTiR may update these Terms with prior notice. Continued use of the Platform after changes take effect constitutes acceptance.
تحكم شروط الاستخدام هذه ("الشروط") استخدامك لمنصة قفتير ("المنصة") العاملة في المملكة العربية السعودية. باستخدامك للمنصة، فإنك توافق على الالتزام بهذه الشروط وفقًا لنظام التجارة الإلكترونية ونظام حماية المستهلك السعودي.
١.١ يجب أن يكون عمرك ١٨ عامًا على الأقل لتقديم الطلبات. باستخدامك للمنصة، تقر بأنك تستوفي هذا الشرط وأنك مؤهل قانونيًا لإبرام معاملات ملزمة.
٢.١ يجب تقديم معلومات دقيقة وكاملة عند إنشاء الحساب. أنت مسؤول عن حماية بياناتك الاعتمادية وعن جميع الأنشطة التي تتم عبر حسابك.
٢.٢ تقديم معلومات هوية أو دفع مزيفة يُعدّ مخالفةً لنظام مكافحة الغش التجاري (المرسوم الملكي م/١٦).
٣.١ تخضع الطلبات لموافقة المصمم المعني. تُعرض الأسعار بالريال السعودي وتشمل ضريبة القيمة المضافة حيثما يقتضي ذلك وفق أنظمة زاتكا.
٣.٢ تُعالَج المدفوعات بأمان عبر Stripe. بتقديمك طلبًا، تُفوّض المنصة بخصم المبلغ المعروض من وسيلة الدفع المختارة.
٤.١ لك الحقوق الممنوحة بموجب نظام حماية المستهلك السعودي (المرسوم الملكي م/٥٤)، بما في ذلك حق الاسترداد والإرجاع كما هو موضح في سياسة الاسترجاع.
٤.٢ يجب أن تكون أوصاف المنتجات دقيقة؛ أي تضليل من المصمم يمنحك الحق في التعويض وفق الأنظمة.
٥.١ توافق على عدم إساءة استخدام المنصة، بما في ذلك الاحتيال أو السلوك المسيء تجاه المصممين أو التقييمات المزيفة أو أي نشاط يخالف الأنظمة السعودية أو المبادئ الإسلامية.
٦.١ تعمل قفتير كسوق يربط المُهديين بالمصممين. لا تتحمل المنصة مسؤولية جودة أو تسليم المنتجات الفردية، وهي مسؤولية المصمم المعني، إلا حيثما يقتضي النظام ذلك.
٧.١ تُعالَج النزاعات أولًا عبر التفاوض بحسن نية، وتُحال النزاعات غير المحلولة إلى المحاكم المختصة في المملكة العربية السعودية.
٨.١ يجوز لقفتير تحديث هذه الشروط مع إشعار مسبق. الاستمرار في استخدام المنصة بعد سريان التعديلات يُعدّ قبولًا لها.
